This module is designed to help substance use disorder (SUD) service providers determine whether their patients’ records are protected by the federal confidentiality law and regulations for SUD treatment records, 42 USC § 290dd-2 and 42 CFR Part 2 (also known as “Part 2”).
SUD treatment providers often experience confusion regarding whether or not Part 2 applies to them or their practice. After reviewing this module, we hope that you will have a better understanding of the requirements of Part 2 and its applicability to you or your practice.
By the end of this module, you will be able to:
- Explore the federal privacy laws that apply to SUD treatment records
- Apply a step-by-step process to determine when Part 2 applies to SUD records
- Recognize how to obtain additional resources related to protected health information (PHI) through the CoE-PHI
